1. Acceptance
By using PawKinect you agree to these Terms. PawKinect (Pty) Ltd is registered in South Africa (Reg Nr: 2026/392682/07). These Terms are governed by South African law.
2. Platform
PawKinect is an online directory and community platform. We do not provide pet services directly and are a platform intermediary only.
3. Eligibility
You must be 18+ to register. All information provided must be accurate. We reserve the right to terminate accounts that violate these Terms.
4. Subscriptions & Billing
Plans are billed monthly in your local currency. First payment is due immediately on sign-up. Prices are inclusive of applicable local taxes where required. PawKinect reserves the right to adjust pricing with 30 days' notice. Event listings are a once-off fee; Pro subscribers receive unlimited listings. Subscribers authorise recurring charges until cancellation.
5. Cancellation & Pause
Cancel anytime via your dashboard. Cancellation takes effect at end of the current billing period. No partial refunds for unused days except where required by local consumer protection law. Subscribers may pause their subscription for up to 3 months (once per 12-month period). During a pause, the listing is hidden, dashboard access is read-only, and all data is preserved. Subscriptions automatically resume after the pause period unless cancelled.
6. Fundraisers & Donations
PawKinect facilitates donations between donors and approved organisations. PawKinect does not take any commission on donations. PayFast charges a 3.5% processing fee on transactions processed through the platform. Organisations may alternatively use their own external payment gateways at no cost through PawKinect. PawKinect does not hold, manage, or control donated funds at any point. All donations via PayFast are transferred directly to the organisation's registered PayFast account. PawKinect is not responsible for how organisations use donated funds.
7. Section 18A Tax Certificates
PawKinect provides a technology tool that enables SARS-approved Section 18A organisations to generate tax-deductible donation certificates. PawKinect is not the issuer of Section 18A certificates — certificates are issued by the approved organisation using PawKinect's technology platform. PawKinect verifies an organisation's Section 18A approval status against the SARS Tax Exempt Institutions database before enabling the certificate generator. However, PawKinect does not guarantee the ongoing validity of an organisation's 18A status, as SARS may revoke approval at any time. Organisations are solely responsible for the accuracy of all information contained in certificates they generate, for compliance with Section 18A of the Income Tax Act No. 58 of 1962 (as amended), and for submitting the required IT3(d) returns to SARS. PawKinect bears no liability for rejected tax deductions, inaccurate certificates, or any tax consequences arising from the use of the certificate generator. Donors should retain certificates for a minimum of 5 years for SARS audit purposes.
8. Listing Approval
All listings are subject to review. PawKinect reserves the right to reject or remove listings that violate these Terms or Community Guidelines.
9. User Conduct
You agree not to post false information, impersonate others, use the Platform unlawfully, or violate any applicable local or international law. PawKinect has a zero-tolerance policy for animal cruelty content.
10. Data Protection
PawKinect complies with POPIA (Act No. 4 of 2013) and the Consumer Protection Act No. 68 of 2008. See our Privacy Policy for full details.
11. Marketplace
PawKinect is not a party to any marketplace transaction. All sales occur directly between buyer and seller. Sellers are solely responsible for product safety, accurate descriptions, delivery arrangements, and compliance with consumer law. PawKinect accepts no liability for defective products, non-delivery, or dietary reactions to pet food products.
12. Homemade & Handmade Items
Sellers of handmade or homemade items confirm all materials and ingredients are pet-safe and accept full product liability. Homemade edible treats are not commercially regulated. Sellers must disclose ingredients, allergens, shelf life, and storage instructions accurately. Buyers with pets with dietary restrictions should verify ingredients directly with the seller.
13. Delivery & Fulfilment
All delivery arrangements are made directly between buyer and seller. PawKinect is not a courier service and accepts no liability for delivery failures, transit damage, or non-arrival. For perishable items, buyers should request freshness and packaging confirmation before purchasing.
14. Payouts
PawKinect retains 8% of platform-processed payments (inclusive of PayFast processing). Net proceeds (92%) are disbursed monthly to registered business bank accounts. PawKinect is not a financial institution. Businesses are responsible for their own tax obligations.
15. Liability
To the maximum extent permitted by local law, PawKinect shall not be liable for indirect, incidental, or consequential loss arising from use of the Platform, marketplace transactions, product defects, delivery failures, or dietary reactions to pet food. PawKinect is a technology platform and intermediary only.
16. Disputes
Disputes shall be subject to good-faith negotiation, then mediation, then the jurisdiction of the South African courts (Gauteng Division, Johannesburg).
